Have you checked for any trouble codes?
If not, do so. And also test your charging system while you're at it!

That doesn't mean that there isn't a pending code...
And test your charging system!

Do you have any modifications to the intake tract? My old roommate put an ebay CAI in his 2004 when he got it and this happened to him. Every now and then it would backfire like crazy and black smoke on start. Putting the stock MAF/CAI back on fixed it.

By charging system you mean the alternator correct? And yes when I purchased the car the previous owner had some spectra short ram intake. Unfortunately I don't have the original intake

I'm willing to bet the intake is a problem. Is stock maf in there at least or is,it the sensor in a new, housing?

Yes. The battery, battery cables, and alternator. A weak charging system can cause all sorts of strange problems on these cars.
And, it could possibly be the CAI like Scotty suggested.
Start with the simple things first.
