This how I pictured It. My drawing isn't the best but he's in egg, your white brown X is where he hit you. So you were behind him he starts to veer right changes his mind, but didn't see you.

I'd say 80% is his fault since he wasn't paying attention you can't go right, and then change your mind. 20% is yours for not paying attention, and possibly speeding. Therefore he needs to cover 80% of the bill your liable for 20%.

My drawing is more accurate because it's only a slight bear right at the fork not a 90 degree turn and the turns aren't perfectly even. One is about 10-20 feet before the other. I wasn't speeding, I was under the speed limit actually, and idk how I wasn't paying attention. I didn't even have music on in the ca for anything I was just driving.

So this is the way I picture it (correct me if I'm wrong)... He is driving in front of you and there is a split in the road so he starts to bear right and while he is making his turn he slows down and as he gets out of the way you go past him but then he changes his mind and swerves left not knowing you are there and hits your side?

But we both live in the same part of Cali so it makes sense that we picture traffic accidents the same way lol... We just gotta remember that she lives East Coast.

Yes! It seemed like he didn't know where he was going and realized that he missed the turn and tried to do a quick U-turn to make it.

I think because he realized that he missed his turn and maybe didn't see me there and thought he could just turn around real fast? I got his statement from the accident. For one it's car scratch and second, it literally says "I was driving with my turn signal on and I got smashed, recked my front end. With a few words in between that I couldn't decipher.

The cops probably thought you were passing just because you were driving a Mustang... Because apparently if you drive a fast car and you get into an accident it is your fault for being reckless... I think its total BS

I don't see how you could be passing. Did the cop ask your passangers what they saw? Usually they do.

The police report is completely hear say. His job is to simply report what you, the other party and what any witnesses have to say. If he said you were passing even if he sited you for it, that would be speculation and in admissible in court. Just be sure you've filed a claim with the other party's insurance company.
Because if you're not at fault your insurance company should not have anything to do with your repairs. It should all be on the other guy and his insurance.

anyway, keep your chin up! sure everything will work out and you'll get get the car straight. hopefully justice will prevail... (and if it doesn't, maybe you can get a handful of us to make little road trip and pay a visit to this jerk and his bimmer!!!)

Haha thank you! . And yes I just picked the report up the other day. Completely inaccurate. And the other drivers statement is almost completely un-ledgable. I posted what it said a page or two back.

I'm sorry. I never had a wreck I'm confident how I drive and I'm always watching those around me. I tend to avoid risks. I started when I was 16/17. I take mostly highways as well. I live out in the country more so. I seldom drive in the city. This happened an same and that driver were the only ones on the road. I like to think I'm a pretty good driver. ;D. I've avoided a number of accidents so far, I tried with this one. For a split second after I swerved I was like "yes! He didn't hit me, I just made it." but then I heard a bang and lost all hope.
