Sign the petition against ford changing names

Here is the news story: Stockton Firm Faces Suit by Ford for Trademark Violation


Allow mustang suppliers to use the word "mustang" In their store name. Petition
prob wont do much but worth a shot to be heard

change it to Stangs Plus. they cant sue over a slang term. if they want to **** themselves in the ***, let them. everything that has Mustang in it can simply change to Stangs whatever. and people will still know what it means, they wont lose business over losing two letters in the name, and they are free and clear.

i still dont see how ford can go after them, ford themselves took the name from a horse. you dont see Mustang Horse owners suing ford, though that would be ironic.

I dunno...I have mixed feelings about this. As a person applying for a trademark, I sure as hell don't want everyone and they're momma using it without my permission. But..for something as widespread as this, with as much advertising and interest, it's basically a household name. I want someone to stand up and take them to court over a free market name, since it's so widespread. That would take some money though...

werd. if ford really does go after anyone using the mustang name, i WILL be selling it, and the title block of the for sale ad would be "Selling due to FORD being ****tards"

they spent so much time on their ****ty cars like the focuz and f00zion and escape, that they forgot the thing that made them ford.

its almost like ford wants to be the super boring company, like toyota. used to be good, now just a bunch of "point a to b" gas savers.

yeah.....and they didnt even put a manual in the lightning, they assemble mustangs like theyre drunk, they need more power stock, they worry about tricking out focuses rather than beefing up mustangs............hey ford, news flash, A FOCUS ISNT YOUR SPORTSCAR, A MUSTANG IS.

Wrong. Ford has "stang", "pony", and various other words trademarked. I still dont understand how you can trademark a word unless its like a one off word that noone else would ever use. I mean ****, I might as well trademark the word "the" and sue anyone with "the" in their business name. Id be rich! ****in ford... stupid *** *****es

I have been doing some studing on cybersquatting verses trademark violations.......

Basically, if you have a website, you can direct it anywhere you want and use name's like we currently do....where the problem come's in, according to ford is, people using the mustang, ford, pony name's and making a profit selling part's, clothing, etc.....i firmly believe ford shouldn't be doing what they are doing as far as going after the little guy that has been helping keep the mustang name alive and well for our hobby.....I also believe that if ford is that worried about it, they should charge like $1.00 a year for those companies using the mustang name, instead of trying to get 10k from them, along with all of the website (store) rights....

I have found case law on a couple of site's that were sued for antisquatting law's, and ford lost...... example:

The decision came in two parts: denying Ford's request for an injunction, and a ruling that without grounds sufficient for injunctive relief, nothing remains of its case.
Originally Ford had accused Corley of three violations under the Federal Trademark Dilution Act (FTDA): trademark dilution, trademark infringement and unfair competition, and sought an injunction against ****generalmotors.com until the matter could be decided before the bench.

However, "Ford has failed to allege facts sufficient to prevail on its dilution, infringement, and unfair competition claims. Thus faced with no chance of succeeding on the merits, Ford may not be granted injunctive relief," the court ruled.

Ford's allegations won't fly because, as the court notes, "to succeed on an infringement claim, a plaintiff must show that the defendant has used the mark in connection with the sale, offering for sale, distribution, or advertising of any goods or services. An essentially identical showing of use in connection with any goods or services is required on an unfair competition claim."
The court decided that Corley is not using the Ford trademark for any commercial purpose, and therefore that there are no grounds for granting a preliminary injunction.

And of course if there's insufficient merit in Ford's claims to grant an injunction, there's hardly going to be enough to proceed at trial.

The court therefore dismissed the suit in a separate ruling issued the same day; and that, one hopes, will be that.

That was kinda what I was thinking, until I read this: Avoiding Trademark Infringement When You Choose A Domain Name.

Of course, it does say that the owner of the trademark must prove that this causes some confusion over who is producing the site... Plus the article seems to focus more on sites that sell a product.

So... I dunno... :dunno:

I really think the law point's to those trying to profit off of a name, not to those that are just trying to share their love for a hobby.

But that is just my .02..........I will continue doing research on this issue and keep everyone up to date....

basically all of the huge massive legal scripts written concerning this deals with one truth. If you can afford a good enough lawyer (have enough money) you can get anything done.

I believe that is different.......Owning an enthusiast site of any type, take's money and time and with out some support, the site won't grow correctly.
I believe what ford is doing is just going after companies whom have the word mustang in their business name's and are selling mustang part's. Even though there are alot of different opinion's on this subject, how else do you sell a quality part to a customer if they can't figure out what you sell? If your business name is Mustang Plus and you are on google, chance's are someone will come and check you out. If you are just "Plus", i don't think very many people will know that you sell mustang part's for all year's of mustangs.
I personally think ford is being kind of sh*tty about this entire deal, if they were building a car and selling it on the market and the car was named "mustang" but yet it looked like a honda, i could see a serious problem with that.......right now, all those lawyer's are doing is extorting money from decent business folk.....
