A copyrighted name, such as Mustang, is applicable only in a relevant situation.

If I become a rasslin star and name myself Mustang, I am not in violation. Nor is Mustang, OK for several reasons including lack of relevance.

If I am in the automotive arena, be it a mamnufacturer of vehicles, parts, or the media, fan clubs, etc then the copyright on Mustang is relevant.

You are allowed a fair use clause, such as using the term in reference to it, but not as the name of your product. So while you can say "I love the Mustang" and be ok you cannot use "I love the Mustang" as your company's name without being in violation.

Of course it is up to the copyright holder to deal with infringers and if they do not then the copy right can be found to have lapsed and you could end up with shiny new Toyota Mustangs.

Then imagine the whines you'd hear from this very site.

Of course there is a simple solution, but hey why bother with it since it involves effort. Get Ford's permission to use the copyrighted term.

I belong to a MoPar realted list and we did that many years ago. They simply asked for the official name and if we had a logo they wanted to ok it. We had to make a small graphics change in the logo to prevent a possible copyright intermingling issue and Chrysler blessed our name and logo. Took more time to come up with a logo than anything else and the change was simply a font change soo it took no time to fix. Funny thing is if Chrysler hadn't asked about a logo we probably wouldn't have thought to have one.

Years later we got a cease and desist letter (after the merger) and we simply showed them the permission we got earlier (before the merger) and all was well.

1. Of course, to be relevant, there has to be a reasonable prospect that the more stupid among us would be confused. ExxonMobil (tm) and Kelloggs (tm) spent huge sums on lawyers fighting over whether the Exxon Tiger on gas station C-stores would confuse stupid customers of Kellogg's Frosted Flakes (featuring Tony-the-Tiger). The relevance--supposedly--was that ExxonMobil was in the "food business" by selling Corn Nuts (tm), beer and Slim Jims (tm) in addition to motor fuels." R-i-g-h-t.

(One wonders why Michelin didn't try to raid ExxonMobil's giant cash box too, based on the fact that some Exxon stations sell tires and Michelin's Uniroyal "Tiger Paw" brand uses a trademarked tiger . . . .)

2. Given FoMoCo's dreadful factory support for "classic auto parts" of any kind, it's kind of hard to see how even the most stupid among us would be confused that someone selling parts FoMoCo scrapped and abandoned making decades ago would think that the MOTHER SHIP ITSELF was now peddling them just because someone deigned to describe what sort of antique car they purportedly fit on.

3. If "Mustang, OK" isn't relevant (even to FoMoCo's money-grubbing legal pirates), then couldn't Ford be snookered by a business named "MUSTANGOklahoma Auto Parts if it were in fact located in Mustang, Oklahoma?

Maybe, but I wouldn't bet even that would stop Ford's quest to drag licensing fees and other "tribute" out of the hard-working folks who keep vintage "pony cars" alive.

Common sense says that "Mustang" is in no danger of losing its trademark uniqueness or confusing anyone with active brain waves if Ford takes a reasonable "fair use" approach to clubs and businesses serving the aftermarket. But finding "common sense" among lawyers or Ford's overpaid, myopic cadre of decision makers is about like finding chastity at the Playboy Mansion. . . .

I didn't read through this entire thread to see if it was posted to not, but I am also a member of the former "muscle mustangs" website. A few motnhs ago they changed their name to MCRParts.com (Muscle Car Restoration Parts).

It really is disappointing. More so that the economy is such that such a big company would lash out at the little guys. I don't see that this accomplishes much good for Ford.
