Finaly Puttin My Foot Down

I got in a wreck in my stang about 4 months ago and it was with a older lady...she was born in 1918... on my road there is a turn light and a reg green light...I was comming fron the opposite way and well her turn light went off and my light turned green and i wasnt stopped when i got to it..I was still rolling and i gave it a lil gas and she turned in front of me and i barley hit her doing maybe 8 or 10 ....The cops gave her a ticket for faliure to yield and a witness that was 2 cars behind her stopped and gave me his number because he saw it was her fault.....Well her insurance company called me and said they it was both of our faults and we had to pay for our own damages....So in my book Faliure to yeild plus whitness saying its her fault = Her fault in my book...So im puttin my foot down and filing the papers today and takin her to court so i can get my car fixed....I feel bad takin this elderly lady to court but thats the only way to get my car fixed....Thats the 3rd time in 6 months i got in a wreck in my car and none were my fault...That why i have a primer grey left finder and bumper...If i have my car another 6 months i might have my whole car primer grey and be able to start the paint job...:woo:

Re: Finaly Puttin My Foot Down

Taking a poor little old lady to court... make sure you get diminished value if it is available to you. That poor old lady... doesn't even realize what's about to hit her and her ins co. And hit em hard!:hammer:

Also, I used to work at a body shop as an estimator. Don't let them put aftermarket parts in place of your factory ones. They never fit right and typically look like ****. Reconditioned parts are okay. Used them all the time on older cars and they fit fine. Remember it's your car, you call the shots.

You get a quote for trade in from a dealer with and without the damage and it is the difference between the two quotes. If the no damage value is more than the ins co value, you should be able to claim it. But being that you car is eleven yrs old, it may not be available to you.

BTW... this is post # 100. Now back to your regular thread.

Damn that, get your $. If its her fault you shouldn't have to pay for it, and if her insurance company wants to push the issue, its their fault she getting taken to court.

Re: Finaly Puttin My Foot Down

just get your insurance company involved. then yours will sue theirs to fix your car, especially with statements from witnesses and a accident report from a officer all pointing at neglegent driving.

and wtf, she was born in 1918? she shouldnt be breathing let alone driving a car. and yes, i am going to hell for statements like that and i dont care.

I firmly believe that once you hit 60, you should have to go for a driving test AT LEAST every 10 years. If you fail, no more drivey. That might be harsh, but these people have to realize that they are a danger to others and themselves. Now saying that, I will probably attempt to hot rod around until the day I die and ***** at anyone that wants to take my license from me. There are 2 sides to it.

I agree. My g-maw is 87 and we don't let her drive, she is a danger to herself and everyone around her. They don't have the reaction time when they are driving like they did when they were 25 and i think they just don't pay attention to their surroundings.

Some people at that age can drive however, my grandfather is 90 and drives better than I do lol. He just prefers to not drive on long trips, he gets sick of concentrating for that long, I'd trust him to drive anywhere within 2 or 3 hours of here with no problem though. He also walks about 5 miles a day among other things. But yes...most ppl that age should not be driving.

i do think that we need more strict, more full driving tests as well as driving tests as you get older or what not

I don't think that would help...I think they go by how fast the trees/houses/etc are passing by to determine whether they are going fast or slow...I doubt they even look at the speedo.

We used to have someone bowl on our league who was 85...I thought I killed him last year when I did a brake stand in the parking lot just as he walked out the door. He almost fell down and looked scared as hell. Thought for sure that was the end.

You cannot ask their age when they come in for the job...you could however say being able to stand for 4 hours without ****ting in your pants is a BFOQ, it might stand up in court. Shoot..it took the supreme court to figure out you have to be a girl to be a Hooter's girl lol.
