Legal options of a detrimental air pump?

I went to a gas station the other day and tried to fill up the air in my tires. I tried to fill up the air the proper way but noticed that the tire wasn't increasing.

I reread the directions, made sure that I was doing it correctly, and then tried all other options. At this point, it became visible that my tire was in fact losing air and was pretty much flat. I went into the gas station and told them the situation. They told me that it was indeed broken and an out of order sign WAS on it but blew off.

We had a tow truck come and pump it back up resulting in a $45 bill. I then proceeded to another gas station to fill up the air in my other tires.

Now, the air machine is supplied to a third party vendor and not by the gas station. They got my complaint today and told me they cant reimburse me for the tow truck because they believe it was a user error and not their pump? They are going to investigate and if it is the pump, I will get reimbursed. What are my legal backup options?

Is it worth taking legal action for under $50? Not really...

But, I do feel your pain on broken air pumps. A couple weeks ago I went to an offroad park and planned on airing up at this gas station right near the park when I left. I went to that gas station: pump out of order. I went to the next station: put some quarters in and it never came on. Next station: same result as the previous. I ended up driving almost 20 miles with 10psi in my tires and spent the very last quarter I had to get the last tire filled.

Always keep a 12V air compressor in the trunk of your car...you can buy one for about $20-$30 from walmart for a cheap one...It's a very wise investment...

As far as legal options, you will just have to eat the $45 bill...sorry

CO2 tanks are another option if you aren't so patient, but cost a bit more.

That's what I was thinking. Only a fairy would call a wrecker when you have a spare in the car. I've changed many a flat tire on the side of the road, you just get used to it after a while.

Yeah, I had a spare, but it was at 10pm (dark) and raining. The thought crossed my mind, but the clerk inside told me that he would call the tow truck and the unimart would PROBABLY reimburse me. I totally regret trusting him on that one...

Hopefully the machine will be found defective, and I'll get my money back.. hell... a portion of my money would be appreciated.

I guess I'm coming from the thought that my car has never and will never as long as I own it and it is not totalled be towed by any other vehicle. That's something I never want to see.
I've only had 1 vehicle ever be towed and that was my truck after I blew the engine in it.

It wasn't towed... the tow truck has an air pump on it... it cost $45 for him to come and use it on site to fill up 1 tire.

Holy crap, you got ripped.

Why didn't you pull it under the awning at the gas station and change the flat? Regardless though, sucks man.
