IF you're in an automatic and stopped at a red light on a hill and don't have your foot on the brake with the brake lights illuminated but since you're in an automatic it won't roll back and someone hits you because you didn't have brake lights shining who's fault is it?

I've never heard of a situation where it is anyones fault who got rear ended (assuming rear ended) besides how could they prove you didnt have foot on brake. Cop or lawyer in your state a better source but if you run into someone... its your fault.

The person in the back. Even if the brake lights aren't showing they still need to be laying attention to a car in front of them.

Thats like me in a manual sitting at a red light; clutch in, 1st gear and waiting for it to turn green. Foot ain't on the brake, but i'm stopped.

If they can't tell if a car 3 feet in front of them is moving or not, than they deserve to have their insurance rates go up

If they hit you they get the ticket for failure to maintain control of their vehicle to avoid an accident.

It depends, have you changed your tail light fluid recently? If not, you clearly are at fault.
