need legal advice about insurance - Mustang Evolution

need legal advice about insurance

As I posted earlier... I was in an accident and it was her fault. Someone was telling me that it is illegal for them to total a car when its their fault? Something like that? I dunno. Anyone have any advice about what I can do? Because they totaled out my car by $1051 over the value of my car...

It shouldn't be illegal when they're liable for the car...check your local laws there in Texas. Is your car registered and insured in Texas?

They can total out your car.

Even though it was her fault her insurance company can total your car out. They are liable only for what the car is worth and nothing more. So they will not pay the extra 1051 dollars to fix your car they will total it out and pay you for what its worth.

You can always appeal to the Texas Department of insurance.

Or you can ask the price they'd offer if you keep the car. Sometimes it's enough to fix the car though it'll probably have a salvage title after that.

Or you can consult an attorney, or your insurance company. I'm pretty sure they have to pay off the car if you owe on it and they total it though.

well, i was also thinking...

last time, the damages were estimated ~7000$ and my buddy fixed it for 4200$. Could i take it to him for an estimate and have my buddy estimate it for like 4950$ (value is 5000$) and just use whatever money he wants to fix it, and for him to keep the rest? (i owe him money anyways, haha) could his estimate override their insurance estimate?

You will have to ask her insurance company that. Not sure but most insurance companies dont allow you to select who you want to take it to they require you to take it to someone they choose

ummm, never heard of that Brent. You get the choice. It's your car... you have the option. I got my car fixed at my friend's for God sakes... They just have to either supply an estimate which means they're a body shop, or use another estimate

when my moms car got messed she did was go to a good family friend who does a nice job for an estimate and he gave one and the insurance company considered it fine. dunno what ur insurance is like tho.

well yea, i have the option to take it anywhere i want.. but since they already did the estimate, im not sure if the new estimate will override the old estimate.

exactly, they'll pay the minimum amount... to whomever that goes to. You go to the guys you want to fix it, and get estimates, and they send it to the cheapest... but you still said that that shop was ok. I got 5 estimates! when I wanted my friend to do it, just to show them how much they'd save

state farm has done nothing but be there when ive needed them. i got my entire stereo replaced with updated stuff along with 1600 bucks worth of body damage all for 100 dollar deductible. Although the premium went up... but still, they were real fast about getting everything fixed when my car was broken into.

I know when I had my wreck this summer..If it went on insurance I was just gonna take the money and fix it myself. My body guy gave an estimate but the insurance adjuster still wanted to come out and take a look at it.

Yea, insurance sucks don't it. You invest all that money into it and for the hope that when something happens to your car, that investment comes back. And then they skip out on the bill and screw you over.

youll never get back any of the money for what you put into the car, unless you have reciepts. then you only get back a percentage of that.

and redrum, give them the better estimate thats under the cost of them totaling your car, more than likely theyll do the cheaper route each time. so tell them youre trying to help them and keep your car at the same time, a win win for both parties.

i know about hatred for insurance. right now im dealing with this dum**** from farmers insurance who says its a myth that you get 3x your medical bills for pain and suffering. when my chiropractor accidentaly sent my insurance the 2k bill, they called me and was asking what happened. i told them the whole thing and they said had it been any other insurance company, theyd have just written you a 5k check and been done with it, but farmers will screw people because they know most people wont take the time and effort to get their money. they fked with the wrong person, cause i got the time and effort to get my money and i will. my freind just settled for 300 over his bills cause he didnt want to f with it, going to court and all. but i will.

i shouldve done what my dad said i should do, open a claim with my insurance and then have my insurance sue theirs for the money, it wouldve happened faster than 9 months. i hate insurance companies.
