Got pulled over, not driving

Ok I wasn't driving but was in the backseat when this happened. We had been at a friend's birthday kegger and were all heading back to another house to crash.
Anyway, its about 4am, we're on Betton/Thomasville and my friend in shotgun, we'll call her "Drunkee", says to pull over, she has to puke. We pull over right in front of Winthrop and our DD, lets call her "Brilliant One", flashes the hazards. Of coure at 4am this is a real attention-getter.
While Drunkee is puking her guts up, halfway in the car, halfway on the grass, a cop pulls up. We're thinking 'oh ****.'
Cop: Is your friend ok?
Brilliant One: Yes officer. Just a lil sick.
Cop: She have too much to drink tonite?
Brilliant One: Yes sir.
Cop: Is she 18?
Brilliant One: Yes sir.
Cop: *Shines the light at her, then Drunkee, then me*
Cop: Get her home and I don't wanna see you kids out on the road again.
Brilliant One: Yes sir.
*Both parties leave*
All I can say is that it was a lucky break for us. Eh...whats the penalty usually for 18+? Same as like any DUI penalty?

They could get her for public intox, probably. Probation (maybe), state substance abuse class (maybe), and a fine (definitely).

Yeah, probably what Markuz said. If he wanted to be a real dick, he had probable cause to search yall and the car, and seems like they always find some shit when that happens.

eh honestly probably nothing thats why he did nothing. I believe there has to be alcohol in close presence to be gotten for anything. and if there was someone 21 in the car then you'd probably get messed with too.

Heh, in PA, your under 21 and they Breathalze you, yea Even a little alcohol shows up you are busted. Our legal limit now is .08 which is about 2 drinks for me(apparently).
I don't think they could have taken her liscense but I'm not all that sure.
Your lucky though...

well technically she should have been okay, only if the driver wasn't drinking...because of a DD, cops are usually gonna be good about that cause it shows responsible drinking and then driving...because she wasn't driving too, unless it was causing a scene, she prolly would have just gotten minor...they don't usually mess around when it comes to people trying to be safe

PLus, you know how much paperwork it would have been for that guy if he busted 2 underages? Prob wasn't worth the hassle becvause he saw you were being responsible.
ALl I'm saying is if you were in ym township you'd be in jail cause cops around here hate kids.

haha ya we were lucky. i was wasted but recall everything. our DD was the same way but good about it.
maybe if it was all guys it'd be different

dont know much about being pulled over or cops, but honeslty i think it was becaseu you were honest with hin that you got let off...if you had tried to lie or acted like an ass probably would of done soemthing.

actually, in some states, chewing gum, or some mouthwashes will make you fail a breathalyzer, so that will sometimes get thrown out the window

mouthwash can make your BAC around .05, but that would be if you gargled, went straight from the bathroom to the car, backed out, went down the street, turned left and bang got pulled over.

that makes no sense what so ever, breathalizers work off of the alcohol samples coming up in your breath from your lungs, so if you using mouth wash this should not be in ur lungs, like if you drank a beer but never swallowed it just spit it out, there should be no alcohol showing on the breathalizer..... maybe i have this wrong but this is what i was always taught.

but if you've got alcohol in your mouth, it will cause a false reading. If you ever get the chance to play around with a breathalizer, take a shot and then immediately breath into it. You'll blow fatal BAC.

Actually probable cause is not sufficient grounds for a search. Probable cause is a requirement for arrest;"the officer must have a reasonable suspicion a crime has been commited and the person being arrested has commited it"
In this case the only way the officer could've legally searched that car is if he gained consent from the owner or the person in possesion of it.
