That's the way I feel about it. If you're unsecured and broadcasting your SSID, you're inviting people to use your access point. If you don't want people to use it, don't broadcast or enable the encryption.

Totally different situation. Stealing someone's bandwith and property are two different things. Actually shouldn't he be protected under the free air act?????? There was a guy who developed a satellite and receiver a few years back that can pick up Dish and Direct TV signals. Now since he was selling the systems, they decided to sue him for it. They lost. Since the signal is being sent all over the earth and he was not modifying or using or copying designs of the Direct tv and Dish systems, it was totally legal in what he was doing, and protected in doing so. So I say if someone is broadcasting and can't encrypt it, it's they're fault.
